§ 97.12 CONSUMER FIREWORKS; CONDITIONS OF USE.
   (A)   Any ignition, discharge or use of consumer fireworks must be by a person who is at least 18 years of age and meets the requirements of the Commonwealth of Pennsylvania statute to purchase, possess, and use consumer fireworks;
   (B)   The ignition or discharge of consumer fireworks is strictly prohibited except during the following dates and times:
      (1)   Memorial Day: 4:00 p.m. to 11:00 p.m.
      (2)   July 3: 4:00 p.m. to 11:00 p.m.
      (3)   July 4: 4:00 p.m. to 11:00 p.m.
      (4)   July 5: 4:00 p.m. to 11:00 p.m.
      (5)   Labor Day: 4:00 p.m. to 11:00 p.m.
      (6)   December 31: 4:00 p.m. to 11:59 p.m.
      (7)   January 1: 12:00 a.m. to 12:30 a.m.
      (8)   January 1: 4:00 p.m. to 11:00 p.m.
   (C)   Prohibition. A person may not intentionally ignite or discharge:
      (1)   Consumer fireworks on public or private property without the express written permission of the owner;
      (2)   Consumer fireworks or sparkling devices within, or throw consumer fireworks or sparkling devices from a motor vehicle or building;
      (3)   Consumer fireworks or sparkling devices into or at a motor vehicle or building or at another person;
      (4)   Consumer fireworks or sparkling devices while the person is under the influence of alcohol, a controlled substance, or another drug;
      (5)   Consumer fireworks within 150 feet of an occupied structure.
