§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   Any person violating the provisions of § 90.02 shall be fined not more than $100 and in default of payment of fines and costs, imprisoned not more than 90 days. Each day’s violation shall constitute a separate offense.
   (C)   Any person violating the provisions of § 90.03 shall be fined not more than $100 and in default of payment of fines and costs, imprisoned not more than 90 days. Each day’s violation shall constitute a separate offense.
   (D)   Any person violating the provisions of § 90.04 shall be fined $50 for the first violation and $100 for each successive violation.
   (E)   Any person violating the provisions of § 90.05 shall be fined $25. Each day’s violation shall constitute a separate offense.
   (F)   (1)   Any person, partnership, corporation, or other entity who in which violates or permits a violation of the provisions of §§ 90.20 through 90.28 shall be subject to the following penalties:
         (a)   First violation a fine of $250.
         (b)   Second violation a fine of $500.
         (c)   Third violation a fine of $750.
         (d)   Fourth and each subsequent violation a fine of $1,000.
         (e)   Each day's failure to comply with any provision of this §§ 90.20 through 90.28 shall constitute a separate violation.
      (2)   The Zoning/Code Enforcement Officer may revoke any license hereunder, or deny any application to renew, upon the finding of a violation of §§ 90.20 through 90.28.
      (3)   The Zoning/Code Enforcement Officer/Police Offers/any surrogate appointee by the Borough Council or Borough Council may revoke any permit if the keeping of backyard chickens attracts wildlife to the premises of the permittee's property or if the permittee's property is not well kept and is not free of odors and is unsanitary.
      (4)   All fines, penalties, and costs collected for violations of §§ 90.20 through 90.28 shall be paid to the Borough of Tatamy for its routine use.
