(A)   Definitions. Terms used in this section shall have the following meanings, whether or not the terms are capitalized. Unless otherwise expressly stated, terms not defined in this section shall be construed consistent with their common and ordinary meaning.
      BOROUGH. Borough of Tatamy.
      MANAGER and BOROUGH MANAGER. The chief administrative officer when appointed by the Borough Council having the powers and duties contained in the Borough Code unless changed by Council.
      SECRETARY/TREASURER and BOROUGH SECRETARY/TREASURER. An appointed position charged with the responsibility for taking meeting minutes; recording and certifying ordinances; attesting to the execution of documents; and is the custodian of borough records and the borough seal. The BOROUGH SECRETARY/TREASURER shall not be a member of the Borough Council and serves an indefinite term at the pleasure of the Borough Council. The BOROUGH SECRETARY shall serve as the chief administrative officer of the Borough Council until a Borough Manager is appointed. All references to Borough Manager shall be deemed to mean the Borough Secretary until a Borough Manager is appointed.
   (B)   Qualifications. The Manager shall be chosen on the basis of supervisory and administrative abilities with special reference to actual experience in and knowledge of accepted practices in respect of the duties of the office as outlined herein.
   (C)   Bond. Before entering upon their duties, the Manager shall give a bond to the borough with corporate surety to be approved by the Borough Council in the sum of $50,000 conditioned for the faithful performance of duties. The premium for the bond shall be paid by the borough.
   (D)   Compensation. The salary and other compensation of the Borough Manager shall be fixed from time to time by motion of Council.
   (E)   Powers and duties.
      (1)   The Manager shall be the administrative officer of the borough and shall be responsible to the Council as a whole for the proper and efficient administration of the affairs of the borough. The Manager's power and duties shall relate to the general management of borough business not expressly by statute imposed or conferred upon other borough officers.
      (2)   Subject to recall by ordinance of Council and the limitations imposed by the Borough Code (see 8 Pa.C.S.A. §§ 101 et seq.) pertaining to the Police Department and other limitations in the Borough Code now in force or hereinafter enacted, the powers and duties of the Borough Manager shall include the following:
         (a)   Supervise and be responsible for the activities of all municipal departments designated by Council;
         (b)   Upon prior approval of Borough Council, shall hire and when necessary for the good of the service, may without prior approval suspend all employees under their supervision, provided that persons covered by the civil service provisions of the Borough Code shall be hired, suspended or discharged in accordance with such provisions; provided, further, that the Manager shall report, at the next meeting thereafter of Council any action taken by authority of this division;
         (c)   Prepare, with the assistance of the Finance Committee, and submit to Council before the close of the fiscal year, or on such alternate date as Council shall determine, a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager shall obtain from the head of each department, agency, board, or officer estimates of revenues and expenditures and other supporting data. The Manager and Finance Committee shall review such estimates and may revise them before submitting the budget to the Council for their review and approval prior to adoption;
         (d)   Shall be responsible for the administration of the budget after its adoption by the Council. The Manager from time to time shall advise Council how each department, agency, board or service is adhering to their individual budget;
         (e)   Shall attend all meetings of Council and its committees with the right to take part in the discussion and shall receive notice of all special meetings of Council or its committees;
         (f)   Shall advise the Secretary/Treasurer of any matters which may be included on the agenda for each meeting of Council and supply facts pertinent thereto;
         (g)   Shall keep the Council informed as to the conduct of borough affairs; submit periodic reports on the condition of the borough finance and such other reports as the Council requests; and make such recommendations to the Council as deemed necessary;
         (h)   Shall submit to Council as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the borough for the preceding year;
         (i)   Shall, together with the Secretary/Treasurer, see that the provisions of all franchises, leases, permits, and privileges granted by the borough are observed;
         (j)   May employ, by and with the prior approval of Council, experts and consultants to perform work and to advise in connection with any of the functions of the borough as directed;
         (k)   With prior approval of Council, shall attend to the letting of contracts in due form and law, shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other borough officer by statute;
         (l)   Shall see that all money owed the borough is promptly paid and that proper proceedings are taken for the security and collection of all the borough's claims;
         (m)   Shall be the purchasing officer of the borough, and shall purchase, in accordance with the provisions of the Borough Code, all supplies and equipment for the various agencies, boards, departments and other offices of the borough. Shall have authority to purchase up to $1,000. Any purchases above that amount shall be with borough approval. Shall keep an account of all purchases and shall, from time to time, or when directed by Council, make a full written report, thereof. Shall also issue rules and regulations, subject to the approval of Council, governing the requisition and purchasing of all municipal supplies and equipment;
         (n)   Shall receive and investigate all complaints regarding services or personnel of the borough and shall report thereon to Council; and
         (o)   Shall cooperate with the Borough Council at all times and in all matters that the best interests of the borough and of the general public may be maintained.
