§ 53.018 MODIFICATION OF NATIONAL CATEGORICAL PRETREATMENT STANDARDS.
   Where the control authority’s POTW treatment plant achieves consistent removal of pollutants limited by national pretreatment standards, the control authority may apply to the approval authority for modification of specific limits in the national categorical pretreatment standards. CONSISTENT REMOVAL shall mean reduction in the amount of a pollutant or alteration of the nature of the pollutant by the POTW treatment plant to a less toxic or harmless state in the effluent which is achieved by the POTW treatment plant in 50% of the samples taken when measured according to the procedures set forth in § 403.7(b)(2) of 40 C.F.R. part 403, General Pretreatment Regulations for Existing and New Sources of Pollution, promulgated pursuant to the Act. The control authority may then modify pollutant discharge limits in the national pretreatment standards if the requirements contained in 40 C.F.R. part 403, § 403.7(a)(2), are fulfilled and prior approval from the approval authority is obtained.
