ORDINANCE NO 20-06
AN ORDINANCE ANNEXING 14 PARCELS OF LAND CONSISTING OF APPROXIMATELY 10.978 ACRES OF LAND ALONG CAMINO DE LA MERCED, CAMINO DEL MEDIO, PASEO DEL CANON WEST AND ST. FRANCIS LANE AND TO AMEND THE OFFICIAL ZONING MAP TO INCLUDE THE ANNEXED PROPERTIES WITH AN R-14 “MULTI-FAMILY RESIDENTIAL” AND M-1 “LIGHT MANUFACTURING” ZONING DESIGNATION
WHEREAS, this ordinance annexes and amends the Town of Taos official zoning map with respect to 14 parcels totaling an approximate 10.978 acres, with UPC Numbers1073147127356, 1073147121351, 1073147115346, 1073147123335, 1073147133343, 1073147082375, 1073147079357, 1073147092360, 1073147092338, 1073147107338, 1073147106316, 1073147123315, 1073147095275, 1073147142280; and
WHEREAS, parcel 1073147142280 shall be split into two lots one being .836 acres and the other being 3.616 acres by an administrative lot split; and
WHEREAS, the property owner filed a petition for annexation of 14 parcels totaling approximately 10.978 acres currently located within the jurisdiction of Taos County to be annexed into the Town of Taos Jurisdiction; and
WHEREAS, Section 16.16.010.6 of the Town of Taos Land Use Development Code requires that all annexed land must be zoned; and
WHEREAS, the property owners have concurrently requested a zone change designation on 13 parcels a total of  7.31 acres from County Rural Area to R-14 “Multi Family Residential” and two parcels totaling 3.61 changing zone designation from County Rural Area to M-1 “Light Industrial”; and
WHEREAS, in accordance with the requirements outlined in NMSA 1978, § 3-7-17 the petition for annexation seeks the annexation of territory contiguous to a municipality, is signed by the owners of a majority of the number of acres in the contiguous territory and is accompanied by a map that shows the external boundary of the territory proposed to be annexed and the relationship of the territory proposed to be annexed to the existing boundary of the municipality; and
WHEREAS, the Town of Taos Annexation Strategic Plan and Vision 2020 support the annexation of the subject property by the year 2020 in order to protect the local ground water supply; and
WHEREAS, the subject lots intends to connect to the Town’s municipal water and sanitary sewer; and
WHEREAS, Section 16.12.020.2 of the Town of Taos Land Use Development Code delegates to the Planning and Zoning Commission the responsibility for review of all proposed annexations and rezoning applications; and
WHEREAS, Sectionhttp://sterlingcodifiers.com/codebook/index.php?book_id=602&section_id=737004 16.12.040 of the Town of Taos Land Use Development Code requires that petitions for annexation and zone designations require review by both the Planning and Zoning Commission and the Town Council; and
WHEREAS, the Planning and Zoning Commission held a duly published, noticed, and posted meeting and public hearing on the annexations and zone designation changes on March 4, 2020 and the Planning and Zoning Commission then recommended that such annexations and a amendments to the zoning map be approved by the Town of Taos Town Council; and
WHEREAS, The Town Council held a duly published, noticed, and posted public hearing on April 14th, 2020 for the purpose of taking evidence relative to, considering, and deliberating upon the present zone change ordinance; and
WHEREAS, the Town Council finds that the proposed zone designation changes meets the requirements set forth in the Land Use Development Code as follows:
The  amendment  is  consistent  with  the  direction  and  intent  of the  existing  town  of Taos master plan; and
The amendment is consistent with the purpose and intent of Town of Taos zoning regulations; and
The  amendment  to  this  title  is  consistent  with  the  existing  land  use  in  the affected neighborhood; and
The  benefit  to  the  neighborhood will  outweigh  any  potential  adverse  impact  upon  the surrounding properties; and
The amendment to this title will not create a danger to the public health, safety, or welfare, nor cause an extraordinary public expense, or create a nuisance; and
The amendment is justified by the  fact that the original zoning was in error, by change in condition in the vicinity, or by change in the town of Taos overall development policy;  and
NOW,  THEREFORE,  BE  IT ORDAINED  by  the  Governing  Body  of the  Town  of Taos, meeting in Regular Session this 14th day of April 2020 and after having held a public hearing  on  the  matter that the  following Ordinance is  hereby  amended,  adopted, approved and ratified:

Zone Change of the following parcels are as follows:
  UPC Numbers: 1073147127356, 1073147121351, 1073147115346, 073147123335, 1073147133343, 1073147082375, 1073147079357, 1073147092360, 1073147092338, 1073147107338, 1073147106316, 1073147123315 a total of 6.513 acres and parcel 1073147142280 shall perform an administrative lot split creating a lot .858 combined with parcels above amounts to a total of 7.371 acres with a zone designation change from County Rural Area to R-14
 
  UPC Number:, 1073147142280 shall perform an administrative lot split creating a lot 2.768 acres and 1073147095275contains .836 acres a total of 3.616 acres with a zone designation change from County Rural Area to M-1

This ordinance shall become effective as provided by law.
