143.04 AWARDING OF BID CONTRACTS.
   (a)   The policy of awarding competitive bid contracts to either the "lowest and best bidder" or the "lowest responsive and responsible bidder" is hereby adopted.
   (b)   The standard to be applied shall be specified in the authorizing ordinance and the public notice requesting bids.
   (c)   A bidder shall be considered responsive if his proposal responds to bid specifications in all material respects and contains no irregularities or deviations from the specifications which would affect the amount of the bid or otherwise give the bidder a competitive advantage.
   (d)   The factors which determine whether a bidder is responsible are: experience of the bidder, financial condition, conduct and performance on previous contracts, facilities, management skills and ability to execute the contract properly.
   (e)   An apparent low bidder found not to be responsive and responsible by the Board of Control shall be notified of the finding and the reasons for it by the Service Director. The notification shall be give in writing and by certified mail.
   (f)   Where a contract is selected for award by the Board of Control to a bidder other than the apparent low bidder or bidders for the construction, reconstruction, improvement, enlargement, alteration, repair, painting, or decoration of a public improvement, the Service Director shall meet with the apparent low bidder or bidders upon a filing of a timely written protest. The protest must be received within five days of the notification required in subsection (e) hereof.
   No final award shall be made until the Board of Control reviews the findings of the Service Director and either affirms or reverses its earlier determination.
