339.12 PERMIT TO HAUL DIRT OR EXCAVATION MATERIAL.
   (a)   All persons, firms or corporations who shall haul by means of horse-drawn vehicles, motor vehicles, trucks or trailers, earth or other material from an excavation the size of which excavation shall measure 100 cubic yards or more, shall before hauling such earth or other material over and upon the streets of the City, obtain a permit from the Chief of Police. Such permit shall specify the maximum weight of the vehicle, including the weight of the vehicle to be hauled, and the route over which such earth or other material shall be delivered to the applicant; one copy shall be filed in the office of the Chief of Police.
   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
