(a) A news rack may be summarily impounded by the City if the placement, use or maintenance thereof creates an imminent danger of personal injury or property damage.
(b) Upon the summary impoundment of a news rack pursuant to subsection (a) hereof, the owner of the news rack shall be notified by certified mail, with a return receipt requested within two business days of such impoundment that he may reclaim the news rack. A news rack impounded under this section shall be reclaimed by the owner within fifteen days of the date of the receipt of the notice. Failure to claim such news rack within the fifteen days shall result in its forfeiture to the City. Any moneys contained within the unclaimed news rack shall be deposited into the General Fund of the City.
