755.08 APPEALS; HEARING.
   (a)    An alarm user may appeal the validity of a false alarm determination made by the Director of Public Safety by providing a written request for a hearing to the Director of Law for the City of Sylvania within ten business days of the date of the False Alarm Notice received. The written request must include the reasons for contesting the notice and/or fee, and must include the name, address, telephone number, and signature of the person submitting the appeal. Failure to contest a determination as provided in this section shall be conclusive presumption that the alarm was false.
   (b)    If a hearing is requested, the Director of Law or his designee shall serve on the alarm user, by certified mail at least ten days prior to the hearing, a written notice of the date, time and location of the hearing. The hearing date shall be set not more than thirty nor less than ten days after receipt of the request for a hearing.
   (c)    The hearing shall be before the Hearing Officer and shall be attended by the alarm user and other persons as requested by the Hearing Officer. The Hearing Officer shall issue a ruling on the appeal, and provide written notice of his ruling to the alarm user and Director of Public Safety, within ten business days following the close of the appeal hearing. The Hearing Officer may uphold, modify, or cancel the alarm determination or fee assessed.
