(a) Notwithstanding the provisions of Section 755.99, any person, firm, partnership, association or corporation which operates an alarm system which signals more than two false alarms in a calendar year shall pay to the City of Sylvania the false alarm fees as set forth in subsection (b) hereof. The fees shall be used to defray a portion of the cost of responding to the false alarms. (Ord. 54-98. Passed 5-18-98.)
(b) The false alarm fee schedule for false alarms during a calendar year shall be as follows:
First and second false alarm | No fee |
Third false alarm | $ 30.00 |
Fourth false alarm | $ 60.00 |
Fifth false alarm | $ 90.00 |
Sixth false alarm | $120.00 |
Seventh and each subsequent false alarm | $120.00 or file criminal charges pursuant to Section 755.04

(c) Exceptions.
(1) Section 755.04 does not apply to any person or entity conducting an authorized fire or emergency drill, or who causes an alarm to be activated while under a reasonably based belief that an emergency is occurring which requires Police and/or Fire Divisions assistance.
(3) No false alarm shall be charged when the false alarm is activated by a disruption or disturbance of local telephone facilities, motor vehicle/utility pole accidents, storm conditions, or extraordinary circumstances not reasonably subject to control by the alarm user.
