So long as the applicant owns or utilizes facilities in the streets of the City, the applicant shall pay to the City three percent (3%) of gross proceeds derived from basic monthly charges paid by the users of such facility, exclusive of charges for remote functions, attachment or installation charges, and charges for other nonprogramming services, and, effective January l, 1990, the applicant shall also pay to the City two percent (2%) of gross proceeds derived from monthly charges paid by the users of such facility for premium programming services, including, but not limited to, Showtime, Home Box Office, Disney Channel, Movie Channel and PASS, but excluding charges paid for Impulse Entertainment or other program-by-program charges.
