§ 51.01 GARBAGE AND TRASH.
   (A)   From and after May 1, 2006, the collection, hauling, transporting, processing, treating and disposing of the garbage and trash in the town shall be done in strict compliance with all rules and regulations applicable to same, whether said rules and regulations are by the United States of America, the state, the county and/or the town.
   (B)   From and after May 1, 2006, the Town Council shall fix and determine, at time appropriate and deemed proper by it, the rates and charges to be assessed and collected within the town, in order to obtain the income necessary to provide the services with relation to garbage and trash as hereinabove set out.
   (C)   (1)   From and after May 1, 2006, through and including April 30, 2007, a charge, in an amount that shall be set by the Town Council from time to time, per dwelling unit per month shall be made for the services of the collection, transporting, hauling, processing, treating and disposing of garbage and trash within the town limits, and in accordance with any and all rules and regulations at any time established by the Town Council, and further in accordance with any and all contracts entered into for said services by the town, and any and all charges to be made upon every dwelling unit within the town limits.
      (2)   From and after May 1, 2007, through and including April 30, 2008, a charge of $7.21 per dwelling unit per month shall be made; from and after May 1, 2008 through and including April 30, 2009, a charge of $7.43 per dwelling unit per month shall be made; from and after May 1,2009, through and including April 30, 2010, a charge of $7.65 per dwelling unit per month shall be made; and from and after May 1, 2010 through and including April 30, 2011, a charge of $7.88 per dwelling unit per month shall be made for the services of collection, transporting, hauling, processing, treating and disposing of garbage and trash within the town limits. Such monthly charge may be changed from time to time as the Town Council shall find reasonable and appropriate.
   (D)   If garbage and trash collection service is requested by any retail, manufacturing and/or commercial establishment within the town, the same may be furnished upon a charge to be collected by the town and paid by said retail, manufacturing and/or commercial establishment in an amount and at times to be determined from time to time upon the agreement by the town to furnish said services.
   (E)   In the event that the owner of a dwelling unit and/or the occupant thereof fails and/or refuses or neglects to pay the monthly charge or any part thereof for the services rendered as herein described for a dwelling unit or any part thereof, said charge or charges shall be an obligation of the owner and the occupant of said dwelling unit and if the owner and/or occupant does not pay the monthly charge of any part thereof within 30 days after it is due, the amount of the unpaid monthly charge, together with the penalty of 10% and reasonable attorneys’ fees shall be recovered by the town, in accordance with I.C. 36-9-30-21.
