(A) The Town Council, recognizing the need to provide support to the Town Marshal and deputy town marshals in the enforcement and in the performance of their police powers for the protection of the town citizens, establishes the Town Marshal’s Reserve.
(B) The Town Marshal’s Reserve shall consist of one but not more than 12 deputy marshals. The Town Marshal shall appoint the Reserve deputy marshals with the concurrence and approval of the Council. The Reserve deputy marshals may not be regular members of the Town Marshal’s Department. Reserve deputy marshals shall have the same police powers as regular members of the Town Marshal’s Department except as limited by rules established by the Town Marshal.
(C) The Reserve shall be entitled to the following benefits to the extent that sums for such benefits are appropriated:
(1) Receive uniforms;
(2) Receive compensation for time lost from other employment because of court appearances; and
(3) Receive liability insurance coverage as extended to the Town Marshal and deputy town marshals.
(D) Reserve deputy marshals need not be residents of the town.
(E) Until they have completed the training and probationary period as specified by the rules established by the Town Marshal, Reserve deputy marshals shall have no authority to enforce any laws or perform any police duties.
(F) A Reserve deputy marshal appointed by the Town Marshal after June 30, 1993, may not:
(1) Make an arrest;
(2) Conduct a search or seizure of a person or property; or
(3) Carry a firearm unless he or she successfully completes a pre-basic course as prescribed under I.C. 5-2-1-9(f) and regulations as promulgated by the Law Enforcement Training Board under 250 I.A.C.
