§ 94.01 DEPARTMENT OF PARKS AND RECREATION.
   (A)   The Town Council hereby establishes the Town Department of Parks and Recreation.
   (B)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      DEPARTMENT. The Town Department of Parks and Recreation.
      PARK. Includes the land and water constituting all parks and other recreation areas within the jurisdiction of the Department.
      PARK BOARD. The Town Board of Parks and Recreation.
   (C)   The Department shall be composed of the Park Board. The Park Board shall be composed of four members who shall be appointed by the President of the Town Council, as the town executive, on the basis of their interest in and knowledge of parks and recreation. No more than two members of the Park Board shall be members of the same political party.
   (D)   (1)   Initial appointments to the Park Board by the Town President shall be as follows:
         (a)   One member for a term of one year;
         (b)   One member for a term of two years;
         (c)   One member for a term of three years; and
         (d)   One member for a term of four years.
      (2)   As such initial term expires, each new appointment is for a four-year term. All terms expire on the first Monday in January, but a member continues in office until his or her successor is appointed.
   (E)   The Park Board shall elect a President, Vice President and secretary at its first meeting of each year. The Vice President shall act as President of the Park Board during the absence or disability of the President.
   (F)   The Park Board may perform all acts necessary to acquire and develop sites and facilities and to conduct programs generally understood to be park and recreation functions and shall have all powers and duties listed in I.C. 36-10-3-17, as amended.
   (G)   The Park Board may create an advisory council and special committees composed of citizens interested in parks and recreation, in accordance with I.C. 36-10-3-17, as amended.
   (H)   The Park Board shall prepare and submit an annual budget. The Park Board may accept gifts, donations and subsidies for park and recreation purposes. A special non-reverting fund shall be established and made available for expenditures for purposes specified by persons donating money to the Park Board.
