§ 73.03 RECREATIONAL VEHICLES PROHIBITED ON TRAILS AND SIDEWALKS.
   (A)   The motorized vehicles defined in division (B) below are prohibited from operating, parking or obstructing the use of public trails or sidewalks within the right-of-way or easements which are either maintained or operated by, or located within, the town. Also included in this prohibition shall be any vehicle determined by a duly appointed officer of the Town Police Department which is operated or parked in a manner that is detrimental to the safety and well-being of pedestrians and bicyclists and restricts normal use of trail or sidewalk.
   (B)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      BICYCLE POWERED WITH ENGINE OR MOTOR. Any motorized piece of equipment or machinery, such as a two-cycle engine or larger that is being used for transportation or travel purposes.
      FARM TRACTOR. A self-propelled implement of agriculture designed and used primarily as a farm implement for drawing implements of agriculture used on a farm and, when using the highways, in traveling from one field or farm to another or to or from places of repairs.
      FARM TRUCK. A truck, trailer or semitrailer and tractor used for the transportation of farm products, livestock or machinery or supplies to or from a farm or ranch. The term includes a covered farm vehicle (as defined in 49 C.F.R. § 390.5). The term does not include an implement of agriculture. The terms may be referred to collectively as FARM VEHICLES.
      FARM VEHICLE LOADED WITH A FARM PRODUCT. Includes a truck hauling unprocessed leaf tobacco.
      GOLF CART. Includes any modified version and means a four-wheeled motor vehicle originally and specifically designed and intended to transport one or more individuals and golf clubs for the purpose of playing the game of golf on a golf course.
      LOW-SPEED VEHICLE.
         (a)   A four-wheeled electrically powered motor vehicle:
            1.   With a maximum design speed of not more than 25 mph;
            2.   With operational and equipment specifications described in 49 C.F.R. § 571.500;
            3.   Equipped with:
               a.   Headlamps;
               b.   Front and rear turn signal lamps, tail lamps and stop lamps;
               c.   Reflex reflectors;
               d.   Exterior or interior mirrors;
               e.   Brakes, as specified in I.C. 9-19-3-1;
               f.   A windshield;
               g.   A vehicle identification number; and
               h.   A safety belt installed at each designated seating position.
            4.   That has not been privately assembled as described in I.C. 9-17-4-1.
         (b)   The term does not include a golf cart or an off-road vehicle.
      MOTORCYCLE.
         (a)   A motor vehicle with motive power that: has a seat or saddle for the use of the rider; is designed to travel on not more than three wheels in contact with the ground; and satisfies the operational and equipment specifications described in 49 C.F.R. part 571 and I.C. 9-19.
         (b)   The term includes an autocycle but does not include a farm tractor, an electric bicycle or a motor driven cycle.
      MOTOR SCOOTER. A Class A motor driven cycle; or a Class B motor driven cycle. MOTOR SCOOTER does not include an electric bicycle
      MOTOR VEHICLE.
         (a)   Except as otherwise provided in this section, a vehicle that is self-propelled.
         (b)   The term does not include a farm tractor, an implement of agriculture designed to be operated primarily in a farm field or on farm premises, an electric bicycle, an electric foot scooter or an electric personal assistive mobility device.
   (C)   This section shall not restrict use by personal mobility devices which operate in accordance with the needs and requirements of the Americans with Disabilities Act (ADA) from operating on public trails and sidewalks.
   (D)   This section shall not restrict the following:
      (1)   Use of trails by manually powered bicycles;
      (2)   Any vehicle defined above from crossing a trail or existing driveway or entrance to access a private or public property; or
      (3)   Use of trail by publicly owned emergency or publicly owned maintenance vehicles.
   (E)   Enforcement powers granted to the Town Police Department shall include the authority to cite parents or legal guardians of a minor or other party operating a motorized vehicle in violation of this section.
   (F)   The Town Police Department is hereby granted the power and authority by this section to seize or impound any motorized vehicle operating in violation of this section.
