(A) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
TRUCK. A vehicle having three axles or a vehicle over 10,000 gross vehicle weight, and includes semi-trailer trucks and either the tractor pulling the same, or the trailer itself. TRUCK includes every self-propelled commercial vehicle designed, used or maintained for the commercial transport of goods or property.
(B) Rule. No person shall operate a truck or vehicle as defined in division (A) above within the corporate limits of the town except as provided herein.
(1) Restricted travel. No person shall drive any truck or vehicle as defined in division (A) above upon any public street of the town at any time; provided, that such trucks or vehicles may be permitted upon such other public streets of the town, upon the direction of a town, county or state police officer, to follow a marked and established town detour, to obtain necessary emergency mechanical repairs or, if for safety reasons, upon the prior approval of the Town Engineer and the Marshal’s Department.
(2) Travel by shortest route.
(a) All trucks and vehicles shall proceed by the shortest combination of state, county and federal highways and shall be prohibited from driving upon any other town streets unless said vehicle is in the process of delivering or picking up goods as further addressed in division (B)(3) below or is itself in the process of being delivered.
(b) A written bill of lading or similar document must be produced by the driver if stopped while driving on a town street to verify such pickup or delivery.
(3) Egress from town.
(a) All trucks, as defined in division (A) above, when finished delivering or picking up goods within the town, shall return to the nearest non-town street by the most direct route unless the truck has a subsequent delivery or pick-up scheduled within the immediate vicinity for that day.
(b) In such cases, the truck may proceed to a subsequent pick-up or subsequent delivery location(s) only if all of the following conditions are met: the driver has in his or her possession a written bill of lading or similar document for the next subsequent delivery or will have a pick-up order upon reaching said subsequent pick-up location(s); or the driver has in his or her possession a written manifest or similar document which shows in clear and plain English all of the scheduled delivery or pick-up location(s) for that day.
(4) Documentation. Any truck driver who is stopped by a law enforcement officer on a street and who does not have a written bill of lading and a written manifest or similar documents as required by this section shall be in violation of this section and shall be issued a citation.
(5) Blocking of town streets. No person shall stop, stand or park a truck on any street, other than for the expeditious loading or unloading of freight, except in cases of emergency when such truck is broken down and unable to move, and except also in the event a moving van is loading or unloading furniture and household goods, or the furniture and equipment and goods, wares and merchandise of a business, in either of which events the operator of such truck will have a reasonable time in which to complete his loading or unloading and move his truck.
(C) Enforcement authority. The Marshal’s Department, Director of the Area Plan Commission and the Nuisance Abatement Officer of the town (hereinafter collectively called “officer”) are hereby authorized to enforce this section in accord with the procedure described herein.
(D) Exceptions. The provisions of this section do not apply to:
(1) Vehicles licensed to operate upon trucks;
(2) Vehicles licensed to carry passengers for hire;
(3) Municipal government vehicles operating on official business;
(4) Farm equipment; or
(5) Public utility vehicles operating on official business.
