§ 35.58 REPORTS AND PUBLIC HEARINGS.
   (A)   After the report of the Fire Hazard Inspection Committee has been filed with the City Council, the City Council shall consider the same at its next regular meeting of the City Council, and if, after considering the report and recommendation of the Fire Hazard Inspection Committee at the regular meeting, the City Council is of the opinion that the report and recommendations justify a public hearing, a public hearing shall be ordered by the City Council and shall be held at a regular or special meeting of the City Council on a date not less than ten nor more than 30 days from the date of the order for a public hearing at the City Hall of the city, at 7 p.m., at which time and place all persons interested in the structure being considered shall have an opportunity to appear and be heard and present evidence and witnesses on their behalf.
   (B)   At least 15 days prior to the date of the hearing, the City Secretary shall cause a notice of the hearing, together with a copy of the report of the Fire Hazard Inspection Committee, to be mailed by Registered Mail, return receipt requested, to the owner or owners of the structure involved, properly addressed to the last undress of the owner of the premises shown on the tax rolls of the city, giving notice of the time, place and nature of the hearing.
   (C)   The public hearing may be adjourned from time to time or from day to day until the hearing shall have been completed.
   (D)   If, after the closing of the hearing, the City Council, based upon the evidence presented at the hearing, is of the opinion that the structure involved is a serious fire hazard to life and property, or is a serious hazard to health or both, or that corrective measures may be taken to remove the dangerous conditions aforesaid and render the structure safe without the necessity of a substantial reconstruction of the structure, the City Council may order the owner of the structure to correct the dangerous conditions, specifying the measures to be taken to render the structure safe; and give the owner thereof a reasonable time of 60 days within which to take and complete the corrective measures. In the event, the owner shall commence repairs of the structure within ten days from the date of the order ordering the repairs and at least ten days prior to the expiration of the 60-day period determines that the 60-day time is insufficient to allow the completion of the repairs, the owner may make application to the City Council to extend the period of time to complete the repairs to an additional 60 days. In connection with the aforesaid extension of time, the owner or owners shall have the burden to show to the City Council that they have used reasonable diligence to complete the repairs requested within the 60-day period. If, however, after the closing of the hearing, the City Council finds that building is a serious fire hazard or serious health hazard and cannot be corrected as stated above, the City Council may declare the building to be a nuisance and order its demolition, giving the owner 60 days within which to cause the structure to be removed from the premises involved.
   (E)   In the event that the owner or owners of the building fail to comply with the order of the City Council within the time specified or the extension of time as authorized by the City Council, then in that event, the City Attorney is hereby ordered and directed to file a suit in a court of competent jurisdiction against the owners to obtain the necessary orders and processes of the court to enforce the orders of the City Council.
   (F)   In the event that the owner or owners of the structure shall fail and refuse to take the corrective measures ordered by the City Council to remove the dangerous conditions to render the structure safe, as herein provided, then, in such event, the City Attorney is directed and ordered to bring suit in a court of competent jurisdiction to cause the structure to be demolished or removed from the premises.
