(A) The subdivider, after all the improvements have been completed in the subdivision, shall present a proposed final plat to the governing body of the city. The final plat must be submitted before the expiration of one year from the date of the application for preliminary plat approval. The final plat shall include the matters set out above with respect to the application for preliminary plat. The final plat shall not be approved until the City Engineer has issued his or her certificate of completion. The certificate of completion is to be obtained in the manner set out in Chapter 152 of this code of ordinances. The certificate of completion and the final plat of the subdivision must be finally approved by the governing body.
(B) No final plat shall ever be approved of the subdivision unless all the improvements have been completed in the subdivision in the manner specified in Chapter 152 of this code of ordinances and all fees and charges have been paid by the subdivider.
(C) The governing body may extend the time for application of the final plat, and may, if the evidence clearly demonstrates that compliance with this subchapter in all respect will work an undue hardship on the subdivider and will not prove a substantial detriment to the city, waive compliance with the provision, except those provisions which affect the health and well being of the citizens of the city and the proposed residents of the subdivision.
