(A) (1) It is hereby found and determined by the City Council that many owners of corner lots abutting street intersections within the incorporated city limits have permitted the growth of vegetation near the street intersections thereby obstructing the view of the street intersection to the traveling public endangering life and property creating a nuisance. Accordingly, it shall be and is hereby declared to be unlawful for any person, firm or corporation, to permit the growth of vegetation, whether trees, flowers shrubs or other plant life, at or near any street intersection above the height of two feet above ground elevation, in a manner as to obstruct the view of the operator of a vehicle approaching any street intersection. Trees presently in place shall not be deemed a violation hereof provided the trees are spaced at least 15 feet apart and are trimmed from the ground elevation to a height of six feet above ground elevation in a manner that the limbs and branches of the tree do not come below the minimum six-foot elevation from the ground upward.
(2) In addition to the criminal punishment provided hereby, the City Council may cause the institution of a civil case in the District Court of the county against the violator of this division to abate the nuisance created by the obstruction as is described in division (A)(1) above.
(B) It shall be and it is hereby ordained to be unlawful for any person, firm or corporation, their agents, servants or employees, to obstruct travel upon any public street or alley within the incorporated city limits for a period of time greater than ten minutes without clearing the obstruction of the street or alley for a period of time not less than ten minutes thereby permitting unobstructed travel of the street or alley during the time.
