864.05 PERMIT ISSUANCE.
   The Mayor shall examine the application, make such investigation as he deems necessary and act thereon within six days from the date of filing. If the application is found to conform to the provisions of this chapter, the purpose is not commercial or otherwise unlawful and the time and place of the proposed broadcast are not such as to constitute an imminent threat to the public safety, he shall approve the same and shall direct the Borough Secretary to issue such permit, to which shall be attached a copy of such application. Such permit must be in the possession of the operator of the sound equipment at all times when the same is in operation in the Borough and, upon request, shall be exhibited to any police officer of the Borough. In directing the issuance of such permit, the Mayor may impose reasonable limitations or restrictions as to the time and place for operation of such instrument or device. In the absence of the Mayor, or in case of his incapacity or failure to act, the President of Council shall perform the duties set forth herein.
