(A) The Police, Fire and Rescue Departments shall charge a fee of $5 to copy reports for the general public. All fees shall be deposited with the Director of Finance for crediting to the proper fund.
(B) (1) The Village of Swanton shall establish a service fee system for the Swanton Village Fire and Police Departments for the delivery of fire and police services, personnel, supplies and equipment to the scene of motor vehicle accidents. The rate of the service fees shall be the usual, customary, and reasonable costs, which includes any services, personnel, supplies and equipment and may vary based on the actual costs of the individual accident. The user fees for Swanton Village Police and Fire Services are listed in the Appendices A and B following this chapter and are incorporated herein.
(2) The service fees shall be charged to the responsible or “at-fault” driver, initially filed with motor vehicle insurance, representing an added on cost of the claim for negligent driving damages to vehicles, properly and/or injuries. The claim shall be filed to the insurance company, the owner of a vehicle, owner of the property or other responsible parties. Residents of the Village of Swanton or any political subdivision or portion of any political subdivision with which the Village of Swanton has a fire and rescue services contract are exempt from any billing or charges not covered by their insurance.
(3) The Village Administrator, with the approval of the Swanton Village Council, may make rules and regulations necessary and expedient in respect to the billing and collection of service fees. The Village Administrator is hereby authorized to enter into an agreement, which replaces the previous agreement, with Cost Recovery Corporation (CRC), 6450 Poe Avenue, Suite 401, Dayton, Ohio to act as the Village’s agent for the collection and recovery of police and fire service fees levied by the Village of Swanton.
(4) All amounts collected as a result of this division (B) shall be placed into separate fire and police funds established by the Village of Swanton to be used exclusively for personnel, supplies, and equipment for the Police and Fire Departments.
