§ 98.04 CARE OF TREES ON PUBLIC PROPERTY.
   (A)   No person shall prune, remove, move, brace, cable, spray, or otherwise perform work on a tree in a tree lawn or other public place without the property owner first obtaining a permit from the village. The person obtaining the permit shall abide by the standards as set forth by the Village Urban Forester and Swanton Tree Commission.
   (B)   The village shall keep all trees standing upon any public place in the village properly pruned so that the branches of such trees projecting over any public sidewalk, private driveway, or into any public street beyond the curb line shall not conflict with the public safety.
   (C)   The village shall have the right and duty to properly prune, water, mulch, and perform any necessary work to any tree existing on any public place in the village to ensure the public safety or to preserve the function or beauty of such public place. The village shall further have the right to remove any such tree or any part thereof which is hazardous or that, by reason of its location or nature, is injurious or detrimental to other public improvements in the village, is injured, or infected with any fungus, insect, pest, or disease which cannot otherwise be controlled.
   (D)   All tree care practices shall conform to all village tree care specifications developed and implemented by the Village Urban Forester and Swanton Tree Commission. Work shall conform to the latest version of OSHA and ANSI standards for tree planting, establishment, and worker safety.
