(A) Swimming pools. Swimming pools shall be maintained in a clean and sanitary condition, and good repair.
(B) Enclosures.
(1) Private swimming pools, hot tubs and spas, containing water more than 24 inches (610 mm) in depth shall be completely surrounded by a fence or barrier at least 48 inches (1,219 mm) in height above the finished ground level measured on the side of the barrier away from the pool. Openings in the fence or barrier shall not allow the passage of a four-inch-diameter (102 mm) sphere. The vertical clearance between grade and the bottom of the fence or barrier shall not exceed two inches (51 mm) for grade surfaces that are not solid, such as grass or gravel, where measured on the side of the fence or barrier that faces away from the vessel. Gates and doors in such barriers shall be self-closing and self-latching. Where the self-latching device is a minimum of 54 inches (1372 mm) above the bottom of the gate, the release mechanism shall be located on the pool side of the gate. Self-closing and self-latching gates shall be maintained such that the gate will positively close and latch when released from an open position of six inches (152 mm) from the gatepost. No existing pool enclosure shall be removed, replaced or changed in a manner that reduces its effectiveness as a safety barrier.
(2) Exception. Spas or hot tubs with a safety cover that complies with ASTM F 1346 shall be exempt from the provisions of this section.
(C) Barrier. Where a wall of a dwelling serve as part of barrier, one of the following conditions shall be met: (IRC AG 105.2(9))
(1) The pool shall be equipped with a powered safety cover in compliance with ASTM F 1346;
(2) Doors with direct access to the pool through that wall shall be equipped with an alarm which produces an audible warning when the door and/or its screen, if present, are opened. The alarm shall be listed and labeled in accordance with UL 2017. The deactivation switch(es) shall be located at least 54 inches (1,372 mm) above the threshold of the door; or
(3) Other means of protection, such as self-closing doors with self-latching devices, which are approved by the governing body, shall be accepted as long as the degree of protection afforded is not less than the protection afforded by division (C)(1) and (C)(2) described herein.
