§ 130.38 PRODUCTS CONTAINING CANNABINOL.
   (A)   (1)   As tetrahydrocannabinol is illegal in any amount in any product offered for sale not in conjunction with 410 ILCS 130/1 et seq. or 505 ILCS 89/1 et seq. and associated administrative regulations, any product containing a delta-9 tetrahydrocannabinol concentration of over 0.3% is a nuisance in the village and shall be illegal for sale, marketing, or distribution in the village. Any person or entity who markets, manufactures, sells, distributes, purchases or possesses any products containing tetrahydrocannabinol shall be guilty of violating this section. Each individual product shall constitute a separate violation of this section.
      (2)   Those individuals who are specifically authorized by the laws of the State of Illinois to possess, manufacture, distribute, market, sell or purchase products containing tetrahydrocannabinol are exempt from this section.
   (B)   The sale of products containing cannabinoid without tetrahydrocannabinol will be permitted by those who have a license to do so. Those entities and individuals who desire to sell products that they claim contain cannabinoid without tetrahydrocannabinol shall have the burden of proving that the product is actually produced from legal portions of the cannabis plant, that the product contains no amounts of tetrahydrocannabinol, and shall apply with the village for a permit to sell cannabinoid products.
