§ 31.04 VACANCIES.
   (A)   If a vacancy occurs on the Village Board and more than 28 months remain in the term and the vacancy occurs at least 130 days before the next general municipal election, the office shall be filled for the unexpired portion of the term by special election at that general municipal election. During the period from the time that the vacancy occurs until the next election of Trustees, the vacancy may be filled by the appointment of a Trustee by the Mayor, with the advice and consent of the Village Board.
   (B)   If a vacancy occurs in the office of the Mayor and more than 28 months remain in the term and the vacancy occurs at least 130 days before the next general municipal election, the office shall be filled for the unexpired term by special election at that general municipal election. The Village Board shall elect one of its members as Acting Mayor, who shall perform the duties and possess all the rights and powers of the Mayor until a successor to fill the vacancy has been elected and has qualified.
