§ 35.093 DISCIPLINARY ACTION.
   (A)   The Fire Chief shall have the authority to take progressive disciplinary actions against a member of the Fire Department for misconduct, including a verbal or written reprimand, or suspension from the Department.
   (B)   The following are examples of conduct, which could result in disciplinary actions being brought against a member, but are not the only reasons misconduct may be charged against a member:
      (1)   Any member appearing intoxicated at any meeting or function governed by this Department;
      (2)   Any member willfully disobeying any officer when on duty;
      (3)   Any member convicted of a felony; and
      (4)   Under the use of illegal drugs during any Fire Department activity.
   (C)   The Fire Chief may not dismiss a member of the Fire Department without the advice and consent of the Village Board of Trustees.
   (D)   If the member wishes to appear any disciplinary action taken against him or her, he or she may do so by appealing in writing to the Chairperson of the Personnel Committee. Appeal must be received within 30 days of the decision of the Fire Chief and will be heard at the next scheduled Personnel Committee meeting.
