For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALTERNATIVE NICOTINE PRODUCT. Any noncombustible product containing nicotine that is intended for human consumption, whether chewed, absorbed, dissolved or ingested by any other means.
BALLFIELD. Includes village-owned baseball, softball, soccer and football fields.
ELECTRONIC NICOTINE DELIVERY SYSTEM. Any product or device containing nicotine, tobacco or tobacco derivatives that employs a heating element, power source, electronic circuit or other electronic, chemical or mechanical means, regardless of shape or size, to simulate smoking by delivering the nicotine, tobacco or tobacco derivatives in vapor, fog, mist, gas or aerosol form to a person inhaling from the product or device.
ENCLOSED AREA. All space between a floor and ceiling or roof that is contained on all sides by walls (exclusive of doorways) or windows, either permanent or temporary, which extend from the floor to the ceiling or roof.
FACILITIES. Buildings, vehicles, equipment and machinery, if they constitute an enclosed area.
SMOKING. Inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe, plant or other tobacco product in any manner or in any form including the use of an electronic nicotine delivery system and/or alternative nicotine product.
VILLAGE. The Village of Sutherland, Nebraska.
VILLAGE PARK. Includes village-owned parks and recreational areas.
