No new wells shall be allowed to be drilled by any person within a 1,000-foot radius around all existing municipal wells serving the municipal water supply and any new municipal wells that may be drilled in the future, pursuant to Title 179, NAC 7, which are the regulations of the State Department of Health, Division of Drinking Water and Environmental Sanitation governing public water supply systems; provided, that a water well constructed for a closed loop heat pump system shall be allowed within 1,000 feet if the following specific conditions are met:
(A) There is an engineering study done to demonstrate that the proposed closed loop heat pump system wells installation will not constitute a pollution hazard to the safety of the drinking water supply;
(B) The village has reviewed the engineering report and the proposed location and installation of the closed loop heat pump system wells meet the village’s requirements;
(C) The village submits the engineering report to the Department of Health with a request for the Department of Health to not consider the closed loop heat pump system well as an encroachment on the municipal water supply system; and
(D) The proposed loop heat pump system meets with the approval of the Department of Health and complies with the requirement of Title 178, Ch. 12 NAC.
