§ 90.050 ANIMAL CREATING A NUISANCE.
   The owner of an animal shall not permit the animal to be at large if such animal is creating a public nuisance. If, after adequate investigation of a complaint, the ACO reasonably determines that an animal is creating or has created a public nuisance while at large, the ACO shall notify the owner of the same and shall instruct the owner to keep the animal under restraint at all times. If the ACO thereafter determines, upon investigation of a subsequent complaint, that the animal is or has been at large again while creating a public nuisance, the owner shall receive a written civil citation from the ACO, and the ACO shall instruct the owner to remedy the nuisance. Should the ACO determine that the animal is creating or has created a public nuisance following the third civil citation, the animal at that time shall be impounded and the owner shall be charged with a violation of this section, and the ACO may apply for a misdemeanor warrant to issue and be served upon the owner.
