§ 154.011-05 MINOR DEVIATIONS FROM SUBDIVISION AND SITE PLANS.
   (A)   The Zoning Administrator shall have the authority to approve certain minor deviations to site plans associated with development approvals to include special use permits, certificate of appropriateness, conditional zoning, and other like development plans. Plans and permits for development under an approved site plan may include minor deviations from the site plan or its conditions, provided such deviations are limited to changes addressing technical considerations that could not reasonably be anticipated during the site plan approval process or any other change that has no material effect on the character of the approved site plan or any of its approved conditions. The following are examples of minor deviations:
      (1)   Minor shifts in parking, building size or location;
      (2)   Minor facility design modifications for amenities and the like; and
      (3)   Minor changes in ingress and egress but shall not include changes that move ingress or egress closer to a neighboring property.
   (B)   Changes that materially affect the basic concept of the site plan or basic parameters set by the site plan conditions are not considered minor deviations, and shall only be changed as amendments to the site plan according to the original approval.
