Sec. 16-63. Pledge required; amount and conditions; release.
   All persons who may have occasion in the prosecution of their work to place material, machinery or anything else in any street in the town may be required to deposit with the town finance officer a certified check or cash for such sums as the council may think sufficient, before the commencement of such work. Such check or cash shall be held by the town finance officer as a pledge that such contractor or other person will at once repair or cause to be repaired any damage to such street, and the town finance officer shall deduct the cost thereof from the amount of such check or cash deposit, and the residue thereof, if any, shall be paid to the person entitled to receive the same. Where the amount deposited is insufficient, the difference due shall be paid by such contractor or other person and in default thereof, the same may be collected by suit. All persons making deposits under this section, having complied with the requirements hereof shall, upon the final cleaning up of the street area used or the repair of any items damaged, receive a release from the council.
