Sec. 15-4. Containers generally.
   (a)   The franchise of both commercial and/or residential solid waste collection in the town shall provide containers for use of households and commercial establishments.
   It shall be the duty of each owner or occupant of a dwelling unit provided with a wheeled ninety (90)-gallon container to place such container at the public right-of-way on the day designated by the town to pick up trash.
   It shall be the duty of each owner or occupant of premises served by containers to use only said containers for the deposit of trash and/or garbage. All refuse is to be placed inside the authorized container. Whenever refuse accumulates it is classified as litter and/or it creates a public nuisance, as determined by the town in accordance with the town provisions of Sec. 15-11, then the owner or other responsible party of such property shall be responsible for removing and disposing of the refuse as directed by the town. The enforcement of such removal shall result in a civil penalty of one hundred dollars ($100.00).
   (b)   Placement of bins.
      (1)   At all other than scheduled collection times, garbage and/or recycle containers must be stored on the premises at a location at least thirty (30) feet from the public right-of-way or behind the front or side wall of the structure.
      (2)   Garbage and/or recycle containers may be placed adjacent to the street no earlier than 12:00 p.m. the day before collection is scheduled and must be returned to an acceptable location by 6:00 p.m. the day after collection.
      (3)   Violations of this section shall be subject to a civil penalty: first offense is a warning, second offense in the amount of fifty dollars ($50), third offense in the amount of one hundred dollars ($100) and after three (3) offenses the property owner shall be force-placed into roll-back cart services.
   (c)   Each residential vacation rental unit must have a minimum of one (1) rollout container for each four (4) bedrooms in the residential vacation unit. For purposes of this chapter, the required number of container shall be based on the next interval of four (4) bedrooms. A bedroom is any room which provides a facility for sleeping including, but not limited to, day beds, sleeper sofa, hide a beds, cots, or roll-away beds. Violations of this section subject the offender to a civil penalty in the amount of one hundred dollars ($100.00).
   (d)   Whenever there are six (6) or more dwelling units in one (1) building, the building shall be required to have a solid waste container (dumpster) and shall comply with normal commercial regulations.
