(a) Public skatepark designated; use regulations. The town may designate, maintain and/or operate a skate park facility, which shall be open to the public for the purpose of riding skateboards, in-line skates, roller skates and/or bicycles. Any designated public skatepark may or may not be supervised and shall be for use by persons using skateboards, in-line skates, roller skates and/or bicyclist only. All other uses are prohibited.
(b) Required riding equipment in public skate parks. It is unlawful for a person to ride or use a skateboard, in-line skates, roller skates or bicycle in a designated public skate park facility unless a person is wearing a helmet, elbow pads and knee pads.
(c) Hazardous recreational activity. Skateboarding, in-line skating, roller skating and/or bicycling at a designated public skatepark facility represents a hazardous recreational activity for participants and the town will not be liable for any injuries incurred by persons participating in the hazardous recreational activity at a designated public skatepark facility owned and/or operated by the Town of Surf City.
(d) Skatepark sign posting.
(1) The town parks, recreation and tourism department shall cause a sign or signs to be posted at designated public skatepark facilities providing reasonable notice of the requirements of this article and stating that any person failing to comply will be guilty of a misdemeanor and subject to citation.
(2) Such signs shall at least afford reasonable notice of the following:
a. Skateboarding, roller skating, in-line skating, and/or bicycling are hazardous activities.
b. Skate at your own risk.
c. Skateboards, roller-skates, in-line skates and bicycling only.
d. Failure to wear helmets, knee pads and elbow pads will subject persons to citation and/or ejection from the facility.
(e) Administration.
(f) The provisions of this article shall be administered by the chief of police and his or her authorized representatives, except where expressly provided otherwise. All other officers and employees of the town shall assist and cooperate in the administration and enforcement of this article. Violations of the provisions of this article may constitute a misdemeanor, punishable by a fine. the town reserves the right to revoke the use of the skatepark to individuals who violate the rules and regulations of the skatepark.
(g) Town skatepark rules.
(1) Notice to all skaters. This is an unsupervised skatepark. Skating is permitted during park hours 8:01 a.m. - 11:59 p.m. Any use of this facility is at your own risk. Use of this facility may result in serious injury.
(2) IN THE CASE OF SERIOUS INJURY, DO NOT MOVE THE INJURED PERSON. ALL SKATING SHALL CEASE IMMEDIATELY. DIAL 911 - YOU ARE IN THE EARL G. & INEZ BATTS RECREATION COMPLEX AT 380 JH Batts Road.
(3) The following rules and regulations have been established for use of the skatepark to ensure participant safety. This is an unsupervised skatepark and its use is free of charge. Please read and obey the following rules:
a. Only skateboarders/skaters/bicyclists are allowed on the skating surface.
b. All skateboarders/skaters/bicyclists must wear protective equipment (helmets and pads).
c. All skateboarders/skaters/bicyclists should visually inspect ramps and park features prior to use.
d. Avoid use when park surfaces are wet, icy, damaged, or otherwise appear damaged or unsafe.
e. Only non-motorized skateboards/skates/bicycles are allowed within the park. No pegs on BMX bikes. Violators are subject to being banned from the park.
f. No one under the age of twelve (12) shall be allowed in the park unless under direct parental or legal guardian supervision.
g. No additional equipment may be brought into the park.
h. Spectators are not allowed in the skating surface area.
i. No food, beverage, alcohol, glass containers, tobacco or vaping products are allowed on skatepark premises.
j. Modifications may not be made to the park features.
k. No fighting or disruptive behavior is allowed on park premises.
l. No loud or vulgar music.
m. Vandalism, including the placement of stickers, decals, and/or graffiti, is illegal. Violators will be prosecuted.
