The town manager shall have the authority to restrict or prohibit swimming, surfing, vehicular travel and access, chumming, fishing, and similar activities on or within the public trust beach areas and the adjacent waters of the Atlantic Ocean in order to protect the health, safety, and welfare of the public in potential or actual emergency situations such as dangerous undertows or rip currents, shark infestations, approaching hurricanes, coastal storms, jellyfish infestations, red algae/red tides, and other similar hazard conditions. Such restrictions and prohibitions may apply to only limited, specific areas or to the entire public trust beach area and adjacent waters of the Atlantic Ocean, and shall be of a limited duration commensurate with the potential or actual danger.
