§ 100.05 EXEMPTIONS.
   The following items are exempt from the provisions of this chapter:
   (A)   Lighting equipment required by law to be installed on motor vehicles;
   (B)   Lighting fixtures maintained by a governmental entity within a public right-of-way or public easement for the principal purpose of illuminating a road, highway, sidewalk, or trail; except that no exemption shall apply to any such lighting that is primarily directed toward property outside the right-of-way or public easement;
   (C)   Lighting for public monuments and statuary on public property;
   (D)   Lighting solely for signs regulated by and in compliance with Chapter 14 of the Land Development Code;
   (E)   Temporary lighting for theatrical, television, performance areas and construction sites;
   (F)   Underwater lighting in swimming pools and other water features;
   (G)   Temporary lighting and seasonal lighting with individual bulbs less than ten watts and 70 lumens;
   (H)   Lighting that is only used for emergency conditions or situations;
   (I)   Lighting approved for a special event in connection with a special use permit; and
   (J)   Lighting required by federal or state laws and regulations.
