§ 110.04 TOW ROTATION LIST.
   The City Police Department has established and maintains a tow rotation list. This section provides qualifications and procedures for participating in the tow rotation list.
   (A)   Qualifications. To be qualified for inclusion on the tow rotation list a tow company must:
      (1)   Maintain a 24-hour tow service;
      (2)   Have not less than one telephone number which is answered 24 hours a day, seven days a week;
      (3)   Use a VSF for storage of any vehicle towed in the city that meets or exceeds the Americans with Disabilities Act (ADA) accessibility criteria established by the United States Department of Justice and certify same in an application for participation in the tow rotation list;
      (4)   Maintain a valid registration to perform non-consent tows in the city;
      (5)   Comply with all state regulations; and
      (6)   Comply with all regulations of §§ 110.20 through 110.23.
   (B)   Restrictions. Only those tow trucks that are included on the tow company’s tow truck license are authorized to respond to a rotation call. Only those persons identified in a registration submitted to the City Police Department are authorized to perform a tow pursuant to the city’s tow rotation list procedure. A tow company may not substitute a tow truck owned or operated by another person when responding to a dispatch. A list of authorized drivers and trucks will be in each patrol vehicle.
   (C)   Forfeiture of calls. Failure of any tow rotation list participant to respond to the location dispatched by the city within 40 minutes of being called will result in the forfeiture of that call. A tow company may not complete a tow more than 40 minutes after the person was dispatched without prior approval of a city police officer.
   (D)   Temporary removal from list. Should a tow company wish to be removed from the tow rotation list for a specific period of time, the tow company shall notify the City Police Department. It shall be the tow company’s responsibility to notify the Police Department of the date when the tow company wishes to be restored to the tow rotation list.
   (E)   Unneeded calls. If a tow company is called to respond to a scene by a police officer and subsequently is not needed, that tow company will be placed as “next in line” on the tow rotation list.
   (F)   Fee for being on the tow rotation list. A tow company desiring to be placed on the tow rotation list shall pay an annual administrative fee of $200 to defray the cost of administering, updating and maintaining the tow rotation list. This fee shall not be prorated or refundable.
   (G)   Violations.
      (1)   A tow truck driver with more than four violations of traffic laws in the prior two years will not be permitted to respond to calls for service. A tow company shall notify the City Police Department whenever a driver authorized on the tow company’s registration exceeds the allowed number of violations.
      (2)   The City Police Department may from time to time investigate the driver record of authorized listed drivers.
