The city shall not prosecute an owner or occupant, as applicable, if:
(A) Within four months of the date of service of notice, the owner received a removal notice related to the same property and the owner or occupant, as applicable, removed, covered or repainted graffiti; or
(B) The owner or occupant, as applicable, approved placement of the graffiti and notified the city of the markings prior to service of a notice under this subchapter.
