§ 51.090 REVOCATION PROCEEDINGS.
   The Director may revoke a wastewater discharge permit in accordance with the following procedure.
   (A)   The Director shall issue to the permittee an order to show cause setting forth the time and place for the revocation hearing in accordance with the procedures in this chapter for issuance of orders to show cause.
   (B)   The Director shall conduct an informal hearing at which time the Director will inform the permittee of the grounds for the proposed revocation and allow the permittee the opportunity to respond the same.
   (C)   The informal hearing conducted under this part is not required to be conducted in accordance with formal rules of evidence and the Director may establish rules for the conduct of the hearings.
   (D)   The Director shall forward written notice to the permittee of a decision to revoke a wastewater discharge permit hereunder together with a statement of the permittee’s right to appeal the decision.
   (E)   The failure of the permittee to appear at the time and place indicated for the revocation hearing shall not prevent the Director from proceeding to revoke a permit hereunder.
