(A) General. A person discharging wastewater containing prohibited waste to the POTW shall retain and make available for inspection and copying by the Director all records and information required to be made, retained or reported under this chapter.
(B) Retention period. Unless required to be retained for a longer period under federal or state law, records required to be retained hereunder shall be retained for a period of not less than three years from the date of creation thereof.
(C) Extension of retention period. The records retention period set forth herein shall be automatically extended for the duration of any litigation concerning compliance with this chapter or where the person has been ordered to retain records for a longer period under the enforcement provisions of this chapter.
(D) Failure to retain a violation. Failure to retain records as required by this section shall constitute a violation of this chapter.
