(A) Any owner, occupant, operator, or agent of a dwelling, dwelling unit, or rooming unit, who has received an order or notice of an alleged violation of this chapter, commits a Class C infraction for each day each alleged violation continues after expiration of the specified reasonable consideration period; provided that no penalty shall be applicable while a reconsideration, hearing, or appeal to a court of competent jurisdiction is pending in the matter.
(B) Any owner, operator, or agent of a dwelling, dwelling unit, rooming unit, dormitory, or dormitory room who violates the provisions of § 151.095(C) of this chapter shall be subject to a civil penalty not less than $100 and not exceeding $5,000 for each failure to comply with this section.
