§ 35.092  TOOLS, EQUIPMENT, AND VEHICLES
   (A)   Employees may use town vehicles, materials, tools, equipment, or labor for personal or private during non-work time but must receive permission from the supervisor.
   (B)   Only the employee is allowed to use the equipment.
   (C)   The employee will be responsible for payment of any repair or replacement of town equipment damaged or destroyed while in the employee’s possession.
   (D)   The employee may not use town tools and/or equipment for monetary purposes.
   (E)   Employees may not expend labor during scheduled work hours for work not related to town business. The town prohibits any employee from performing private work for himself, another employee, or a non-employee.
   (F)   Any employee of the town office or department who is required to operate a town vehicle in the course of his or her employment shall be subject to the following conditions and restrictions:
      (1)   Periodic record checks at the Bureau of Motor Vehicles at least bi-annually;
      (2)   Use of seat belts by all passengers;
      (3)   Re-assignment or other appropriate personnel action in the event of license revocation, suspension, or arrest for a DUI;
      (4)   Employees who are required to operate town vehicles during the course of their employment must immediately report any condition that adversely affects their ability to operate such vehicle(s) and/or equipment;
      (5)   Must be able to meet insurability standards/requirements of the town liability Insurance provider; and
      (6)   Maintain a valid driver’s license.
   (G)   In addition, employees must use assigned town vehicles, when available, for the purpose(s) authorized and must not permit unauthorized passengers in the town vehicles.
   (H)   Reimbursement for necessary emergency road service and repairs, parking, and highway-related tolls require appropriate receipts for reimbursement.
   (I)   Any employee who operates a vehicle or piece of equipment is responsible for checking and maintaining the oil, water, fuel, and tires before operating.
   (J)   In the event of an accident, employees must do the following:
      (1)   Assist any injured party if possible and call 911;
      (2)   Do not move any vehicles unless instructed to do so by proper police authority;
      (3)   Write down all pertinent facts, such as the other driver’s name, address, telephone number, license plate number, driver’s license number, social security number, and name of insurance, policy number, name, address, and telephone number of any injured party or witnesses;
      (4)   Do not admit any fault or make any oral or written statements but give your name, address, telephone number, and the like, as required; and
      (5)   Notify their supervisor or his or her designee and submit a written report as soon as possible.
