9-1-3: OFFICE OF BUILDING INSPECTION; ENFORCEMENT:
   A.   Office Created: There is hereby created the office of building inspection and the official in charge shall be known as the Building Inspector.
   B.   Nonliability For Official Acts: The Building Inspector and any other City employee charged with the enforcement of the building codes and housing codes, and other related ordinances, acting in good faith and without malice for the City in the discharge of their duties, shall not thereby render themselves liable personally; and they are hereby relieved from all personal liability for any damage that may occur to persons or property as a result of any act required or by reason of any act of omission in the discharge of their duties. Any suit brought against the Building Inspector or any such employee, because of such act or omission performed in the enforcement of any provisions of the building code or housing code or other ordinance, shall be defended by the legal department of the City until final termination of the proceedings.
   C.   Right Of Entry; Complaints: If the owner or occupant of any building, premises or portion thereof refuses to allow the City Building Inspector to enter the building, premises or portion thereof at reasonable hours in the discharge of the duties imposed upon the Building Inspector by this Code, the Building Inspector shall obtain, upon oath or affirmation, a search warrant from a Magistrate Court by filing a complaint made before the Magistrate. The complaint shall:
   I.Set forth the particular buildings, premises, or portion thereof sought to be inspected;
      2.   State that the owner or occupant of the building, premises or portion thereof has refused the Building Inspector entry:
      3.   State that inspection of the building, premises or portion thereof is necessary to determine whether it complies with the requirements of this Chapter;
      4.   Set forth the particular provisions of this Chapter sought to be enforced;
      5.   Set forth any other reason necessitating the inspection, including knowledge or belief that a particular condition exists in the building, premises or portion thereof, which constitutes a violation of this Chapter;
      6.   And state that the Building Inspector is authorized by the Board to make the inspection. The Building Inspector shall be furnished with an identification card from the Board indicating his authority and must present such to the Magistrate for purposes of this Section, and to all other persons when requested to do so.
