913.09 TREE PLANTING.
   (a)   The recommended list of public tree species for the Village of Sunbury, State of Ohio is available through the Village of Sunbury Tree and Landscape Commission and available at the Village office. No species other than those in the list may be planted as street trees or park trees without written permission of the Village of Sunbury.
   (b)   In areas developed on or before September 5, 2008, the following minimum width of tree lawns should be followed for tree plantings within a public street right-of-way: ten (10) feet for large trees, six (6) feet for medium trees and four (4) feet for small trees. The trees shall be planted in the center of the tree lawn.
   (c)   In areas developed after September 5, 2008, in accordance with Ordinance 2008-24, Section S81.16.01(19) no trees shall be planted within the public street right-of-way.
   (d)   Distances and Clearances:
      (1)   The spacing of new trees shall follow the following regulations: Sixty (60) ft. between large trees, forty (40) ft. between medium trees, twenty (20) ft. between small trees.
      (2)   All trees should be planted a minimum of ten (10) ft. from all signs, street lights, utility poles and fire hydrants.
      (3)   All new trees should be planted a minimum of thirty-five (35) ft. from the edge of pavement of all street intersections.
      (4)   All trees shall be a minimum of ten (10) feet from driveways.
      (5)   All trees, outside the right-of-way, shall be planted a minimum of five (5) feet from sidewalks.
      (6)   Only small trees will be allowed to be planted under utility lines provided that when the tree is fully grown it does not obstruct, impede, or interfere with the lines. (Ord. 2008-30. Passed 10-15-08.)
