This chapter provides full power and authority to the Commission to include in their annual plan to counsel recommendations involving all trees, plants and shrubs located within street rights- of-way, parks and public places of the Village; and to trees, plants and shrubs located on private property that constitute a hazard or threat as described herein. Upon consideration of said plan, the Sunbury Village Council may notify property owners of hazardous trees which need to be removed on their property for public safety. If removal is mandated, property owner has 60 days to do so. Otherwise, the Village will remove the tree and certify the cost thereof to the Delaware County Auditor to be included as an assessment on the owner’s property tax duplicate.
