509.08 MINOR'S CURFEW.
   (a)   Curfew for Minors Under Twelve. No minor under the age of twelve years shall loiter, idle, wander, stroll, or play in or upon the public streets, other public places, places of amusement and entertainment, vacant lots or other unsupervised places during the period from darkness to 6:00 a.m.; provided, however that the provisions of this section do not apply to a minor accompanied by his parent, guardian, or other adult person having the care of and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his parent, guardian, or other adult person having the care and custody of the minor.

   (b)   Curfew for Minors Under Eighteen. No minor under the age of eighteen years shall loiter, idle, wander, stroll, or play in or upon the public streets, other public places, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 11:00 p.m. and 6:00 a.m. of the following day, official Village time; provided, however, that the provisions of this section do not apply to a minor accompanied by his parent, guardian, or other adult person having the care of and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his parent, guardian, or other adult person having the care and custody of the minor. During the period of time between May 1, and October 31, of each year, the time will be 11:30 p.m. Curfew.

   (c)   Enforcement Against Parent, Guardian, Etc. The parent, guardian or person having the legal custody and control of any minor violating any of the provisions hereof shall be deemed guilty of a misdemeanor.
   (d)   Unlawful for Minor to Loiter.
      (1)   No person, firm or corporation operating or in charge of any place of amusement, entertainment or refreshment, or any other place of business to permit any minor under the age of eighteen years to loiter, loaf, or idle in such a place during hours prohibited by this section.
      (2)   Whenever the owner or person in charge or in control of any place of amusement, entertainment, refreshment, or other place of business shall find persons under the age of eighteen years loitering, loafing, or idling in such places of business, he shall immediately order such person to leave, and if such person refuses to leave the place of business, the operator shall immediately notify the Police Department and inform them of the violation.    (e)   Penalty. Whoever violates any provision of this section shall be guilty of a minor misdemeanor.
