311.04 TRAFFIC CONTROL DURING CONSTRUCTION ACTIVITIES.
   (a)   Any construction activity that results in a temporary one-lane, two-way traffic control operation or otherwise significantly affects the progress of traffic on arterial, collector or other roadways that the Chief of Police identifies or decides that the public safety is at risk within the municipal boundaries of the Village shall require traffic control, which shall be performed under a permit by the Chief of Police. All temporary traffic control methods and devices shall be in accordance with the latest edition of Ohio Manual of Uniform Traffic Control Devices as directed and approved by the Chief of Police. Temporary traffic disruptions caused by mobilization of equipment shall not require traffic control services unless the Chief of Police determines the need for traffic control is necessary.
   (b)   Traffic control services shall be provided by uniformed officers of the Village of Sunbury Police Department or other officers of other police departments as necessary or by private companies having the requisite training and experienced training to be flaggers all of which as may be determined by the Chief of Police, and will be carried out in a manner directed by the Chief of Police. If the Chief of Police determines that the contractors or flaggers are not providing proper traffic control, the Chief of Police shall assign a uniformed, off-duty police officer to the construction project to properly control traffic at the expense of the contractor.
   (c)   No party in need of traffic control services shall begin any construction activities without first having a permit signed by the Chief of Police or designee authorizing the construction activity to proceed and dictating the manner and provider of traffic control services.
   (d)   Any party requesting traffic control services to be provided by the Village shall be required to pay the Village of Sunbury Police Department’s officers assigned to provide traffic control services at the current hourly rate in place for such traffic control services as determined by the Sunbury Village Chief of Police.
