127.01 SMOKING PROHIBITED IN VILLAGE BUILDINGS.
   (a)   Definitions. The following words and phrases, whenever used in this section, shall be construed as defined herein.
      (1)   “Sign” means legible, English lettering of a contrasting background to clearly indicate where smoking is not permitted and to provide related information. A sign shall be of sufficient size to be clearly legible to one of normal vision.
      (2)   “Smoking material” means any cigar, cigarette, pipe, weed, plant or other smoking equipment in any form.
   (b)   Restrictions on Smoking in City Buildings.
      (1)   Smoking or the possession of lighted smoking material in any enclosed structure or building owned by, leased by, or controlled by the Village is hereby prohibited. This prohibition is applicable to the public at large and employees of the Village.
      (2)   Signs indicating that smoking is prohibited shall be clearly, sufficiently and conspicuously posted in every room, building or other place where smoking is prohibited.
   (c)   Designation of Smoking Areas. The Village Administrator is hereby authorized but not required to designate areas where smoking shall be permitted outside any enclosed buildings owned by, leased by, or otherwise controlled by the Village.
   (d)   Enforcement. Enforcement shall be implemented by the Administrator of the Village of Sunbury, Ohio.
   (e)   Violations and Penalties.
      (1)   No person shall smoke or possess lighted smoking material in any area restricted by the provisions of this chapter.
      (2)   Whoever violates any provision of this section is guilty of a minor misdemeanor.
      (3)   Each day on which a violation of any provision of this section occurs is a separate and distinct offense and shall be punishable as such.
