ORDINANCE NO. 233-A
AN ORDINANCE AMENDING ORDINANCE 233
TITLE 4, CHAPTER 2, MATERIALS DEPOSITED IN DUMPSTERS
WHEREAS, Summit County previously adopted Ordinance 233 on June 13, 1994, which has since been codified in Title 4, Chapter 2, “Materials Deposited in Dumpsters,” of the Summit County Code setting forth the prohibitions for materials deposited in dumpsters; and
WHEREAS, since the adoption of Ordinance 233, Summit County Public Works has been facing difficulties with residents of and visitors to Summit County who improperly use dumpsters provided for by Summit County; and
WHEREAS, in Public Works’ experience, they have seen violations ranging from the dumping of hazardous or recyclable materials into dumpsters designed for household waste to the dumping of materials outside of the dumpsters, among others; and
WHEREAS, the above-described violations are not accounted for in the current version of Ordinance 233 so it is in the County’s best interests to amend Ordinance 233 to provide for greater enforcement mechanisms to ensure the health and safety of Summit County residents;
WHEREAS, this Ordinance accordingly amends Summit County Code, Title 4, Chapter 2.  
NOW THEREFORE, the County Legislative Body of the County of Summit, State of Utah, hereby ordains as follows:
Section 1: The Council hereby amends the Summit County Code, Title 4, Chapter 2 in accordance with Exhibit A herein
Section 2: Effective Date: This Ordinance shall take effect fifteen (15) days after the date of its publication.

4-2-1: DEFINITIONS:

When used in this chapter, the following words or terms shall have the following meanings:

DUMPSTER: A container placed at various locations throughout Summit County for the collection of Household Garbage by Summit County or its designated agents, assigns or lessees.
 
RECYCLE DUMPSTER: A container placed at various locations throughout Summit County for the collection of recyclable materials by Summit County or its designated agents, assigns or lessees. Acceptable materials will be designated on the Recycle Dumpster or on an adjacent sign.


HOUSEHOLD GARBAGE: All waste accumulations of food items, plastics, glass, metal food containers and paper generated by a residential household  and similar waste from a residence. "Household Garbage" does not include metal (except that which may have contained food products), rocks, concrete, bricks, plaster, dirt, lumber, building products, animal carcasses (wild or domestic), "hazardous materials", as defined by federal or state law, electronic waste of any kind, batteries of any kind, flammable materials, or refuse and garbage or waste materials from industrial, commercial or construction operations, including new residential construction and remodel construction, and other similar waste not specifically listed.
 
4-2-2: DUMPSTER USE
All Dumpsters maintained and provided for public use by Summit County shall be for Household Garbage only, unless otherwise clearly marked by signs posted by Summit County at the Dumpster site. Dumpsters shall be for the use of residential homes that do not have curbside collection or specific Dumpster options already provided by Summit County, a municipal entity, or other entity authorized to provide such service. Each residential household shall be limited to a combined total not to exceed 1.3 cubic yards of Household Garbage per month. All cardboard boxes or other bulky containers should be flattened prior to placement in the Dumpsters. When cardboard recycling options are provided, all cardboard shall be placed within the Recycling Dumpster provided. Recycling materials shall not be placed outside the Recycling Dumpster provided.
4-2-3: PROHIBITED MATERIALS:

It is unlawful for any Person to deposit or cause to be deposited in a Dumpster or Recycle Dumpster any materials, products or items except Household Garbage or recyclable materials when provided and designated on the Dumpster.
 
4-2-4: DUMPING FLAMMABLE MATERIALS.
It is unlawful for hot coals, charcoal, or any solid fuel source not fully extinguished and cool to the touch to be placed in the county Dumpsters.
4-2-5: DUMPING OUTSIDE OF DUMPSTER
A. All Household Garbage shall be deposited within the confines of the Dumpster.  It is unlawful for any Person to dump, deposit or place or cause to be dumped, deposited or placed any Household Garbage at a Dumpster site maintained by Summit County at any place other than within the confines of the Dumpster.  It is unlawful for any Person to dump, deposit or place or cause to be dumped, deposited or placed any other materials (not including Household Garbage) at a Dumpster site maintained by Summit County.
B. All recyclable materials shall be deposited within the confines of the Recycle Dumpster when provided and labeled.  It is unlawful for any Person to dump, deposit or place, or cause to be dumped, deposited or placed any other non-recyclable materials in a Recycle Dumpster. 
4-2-6: SCAVENGING OR REMOVAL OF CONTENTS
It is unlawful for any Person to enter, reach into, scavenge from, or remove any contents from a Dumpster or Recycle Dumpster.
4-2-7: LOITERING ON SITE
It is unlawful for any Person to loiter upon, park, stand, or remain on a Dumpster or Recycle Dumpster site maintained by Summit County except for the purpose of immediate disposal.
4-2-8: DAMAGE TO DUMPSTERS AND RECYCLE DUMPSTERS
It is unlawful for any Person to willfully or negligently break, deface or injure any Dumpster or Recycle Dumpster.
4-2-9: PENALTY:

A violation of this chapter is a class B misdemeanor, punishable as provided in section 1-4-1 of this code.
