925.19 PERMIT MODIFICATION.
   (a)    The Director may modify an individual wastewater discharge permit for good cause, including, but not limited to, the following reasons:
      (1)    To incorporate any new or revised federal, Ohio, or County of Summit pretreatment standards or requirements;
      (2)    To address significant alterations or additions to the User's operation, processes, or wastewater volume or character since the time of the individual wastewater discharge permit issuance;
      (3)    A change in the POTW that requires either a temporary or permanent reduction or elimination of the authorized discharge;
      (4)    Information indicating that the permitted discharge poses a threat to the County's POTW, County personnel, receiving waters, or renders wastewater treatment sludges unfit for beneficial use;
      (5)    Violation of any terms or conditions of the individual wastewater discharge permit;
      (6)    Misrepresentations or failure to fully disclose all relevant facts in the wastewater discharge permit application or in any required reporting;
      (7)    Revision of or a grant of variance from categorical pretreatment standards pursuant to 40 C.F.R. Section 403.13;
      (8)    To correct typographical or other errors in the individual wastewater discharge permit; or
      (9)    To reflect a transfer of the facility ownership or operation to a new owner or operator where requested in accordance with Section 925.20 of this Chapter.
   (b)   Existing permit holders who become subject to a national categorical pretreatment standard or who make changes in plant processes or operations which appreciably affect the nature or volume of their wastewater shall update their permit application within ninety (90) days of the occurrence of either event. The Director shall review the updated permit application and, if a new or modified permit is to be issued, shall give the discharger at least thirty (30) days notice of the new provisions prior to such changes becoming effective. Any changes or new conditions in the permit shall include a reasonable time schedule for compliance.
   (c)   The Director may reclassify a discharger after review of existing information from permit applications, monitoring, reporting and inspections. If reclassified as a significant industrial User, the User shall apply for an individual wastewater discharge permit in accordance with Section 925.14 of this Chapter. If an existing permit holder is reclassified as a nonsignificant user, the Director shall issue an order revoking the permit and exempting the user from the requirements applicable to significant users.
