103.01 ELECTED OFFICIALS; TYPE OF ELECTION; DATES.
   (a)    Officials shall be as follows with term of office:
      (1)    Mayor: Must be a resident of the City. The office will consist of a term of four (4) years after which time the officeholder may be reelected with no limitation on terms of office. Must be a registered voter. If at any time he becomes a non-resident of the City, he shall immediately resign his office.
      (2)    Recorder: Must be a resident of the City. Office will consist of a term of four (4) years after which time the officeholder may be reelected with no limitation of terms of office. Must be a registered voter. If at any time he becomes a non-resident of the City, he shall immediately resign his office.
      (3)    Member of Council: Must be a resident of the ward for which the office is being sought at the time of election. The office will consist of a term of four years after which the officeholder may be reelected with no limitation of terms of office. Must be a registered voter. If at any time he becomes a non-resident of the ward in which he was elected he must resign immediately. There shall be seven (7) Members of Council all to be elected.
   (b)    (1)    The City shall be divided into four (4) wards. Each ward will coincide with one of the county voting precincts for the City. These wards, with their polling places and coinciding precincts are listed as follows:

      (2)   Each ward shall have a minimum representation of one (1) Member of Council.
      (3)   In order to get equal representation as to distribution of population, there shall be elected the following number of Members of Council:
 
Ward I
Two (2) Members of Council
Ward II
One (1) Member of Council
Ward III
Two (2) Members of Council
Ward IV
Two (2) Members of Council
This distribution is based on a representation of one (1) Member of Council per each four hundred (400) citizens of a ward, based upon the 1990 census.
   (c)    Council shall have the authority to fill any vacancies which may occur during its term of office due to resignation or disqualification. Such appointment shall run until the next City election.
   (d)    Election: The election shall be held on the second Tuesday in June, 1991 and every four (4) years thereafter.
      (1)    There will be no primary or convention; candidates will file for office and run as non-partisans.
      (2)    The filing period shall be from 8:00 a.m. on the first Monday in February through 12 midnight on the second Saturday after the filing period starts. Filing forms postmarked by midnight of the final filing day shall be accepted and considered as timely filed.
      (3)   Each candidate filing for such office shall file on the City approved filing forms available at the Recorder’s Office.
      (4)   There shall be a filing fee of one percent (1%) of the annual salary of the office being sought with a minimum fee of ten dollars ($10.00).
      (5)   All citizens registered to vote and living in the City limits shall be eligible to vote for the non-partisan candidates.
      (6)   The candidates receiving the highest number of votes shall be elected for each office.
      (7)   In the event of a tie, the winner will be decided by methods outlined in the West Virginia Code of 1931, as amended, governing municipal elections.
   (e)    Financial Reports: Each candidate shall file a financial report pertaining to contributions and expenses using the State financial reporting forms. These forms can be obtained at the Recorder's Office. The reports shall be filed on the dates set forth on the forms provided by the Secretary of State, which can be obtained at the Recorder's office.
   (f)   All other procedures for election shall follow the West Virginia Code of 1931, as amended, for election laws. (Ord. 1-28-91.)
